Sirius needs to understand that DUDLEY was in the wrong, not the Runespoor. Even if Dudley had died, which he didn't, Sirius would be in the wrong if he put the snake down. The runespoor doesn't deserve to die for attempting protect its young, which is well within its rights.
Dudley knew perfectly well what he was doing was wrong and did it anyways out of sheer selfishness. Did Dudley really think that his actions would be unpunished? Besides, the likelihood that he would have been allowed to keep a 'dangerous' snake is very low.
